Terms of Service

Please read these Terms of Service ("Terms") carefully before using Book A Band. By creating an account or using the app, you agree to be bound by these Terms. If you do not agree, do not use Book A Band.
1. Overview
Book A Band ("we," "us," "our") is a marketplace platform that connects musicians and bands ("Performers") with individuals and organizations seeking to book live music for events ("Clients"). We facilitate discovery, communication, booking, and payment between Performers and Clients. Book A Band is not a party to the agreements between Performers and Clients and does not provide, control, or guarantee the services offered by Performers.
2. Eligibility
You must be at least 13 years old to create an account. If you are between 13 and 18, you must have the consent of a parent or legal guardian. By using Book A Band, you represent that you meet these requirements and that the information you provide is accurate.
3. Accounts
You may register as a Client, a Performer, or both. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts at our discretion for violations of these Terms.
4. Performer Profiles & Content
Performers are responsible for the accuracy of their profile information, including band name, bio, pricing, availability, media (photos, videos, audio), and service descriptions. All content uploaded to Book A Band must:
- Be accurate and not misleading
- Not infringe on the intellectual property rights of any third party
- Not contain offensive, defamatory, or illegal material
- Comply with all applicable laws and regulations
We reserve the right to remove content that violates these guidelines without prior notice.
5. Bookings
Bookings are agreements between the Client and the Performer. Book A Band facilitates the transaction but is not a party to the booking agreement. When a Client submits a booking request:
- The Performer may accept or decline the request
- Upon acceptance, the Client is charged a deposit as set by the Performer's service pricing
- The remaining balance, if any, is to be settled directly between the Client and the Performer
Both parties are expected to fulfill their obligations in good faith. Performers must honor accepted bookings, and Clients must provide accurate event details and attend scheduled events.
6. Quote Requests
Clients may post quote requests describing their event needs. Performers may respond with quotes including pricing and service details. Submitting or receiving a quote does not constitute a binding agreement. A booking is only created when a Client accepts a quote and completes payment.
7. Emergency Beacons
Clients may post emergency beacons to find available Performers on short notice. Emergency beacons require a non-refundable $5.00 activation fee. The minimum offered rate for an emergency beacon is $50.00. Performers may accept at the offered rate or submit a counter-offer. If no Performer is matched before the beacon expires, the activation fee is not refunded.
8. Payments & Fees
All payments are processed securely through Stripe. By using Book A Band's payment features, you also agree to Stripe's Terms of Service.
- Platform Fee: Book A Band charges a 2.5% service fee on each deposit transaction, deducted automatically at the time of payment.
- Deposits: Clients pay a deposit to confirm a booking. The deposit amount is set by the Performer's service or package pricing.
- Performer Payouts: Performers receive payouts through Stripe Connect. Performers are responsible for completing Stripe's onboarding and identity verification.
- Taxes: Performers are responsible for any applicable taxes on income earned through the platform. Book A Band does not withhold taxes on your behalf.
9. Cancellations & Refunds
Performers may set their own cancellation policies, including a free cancellation period and a cancellation fee percentage. These policies are displayed on the Performer's profile.
- Client Cancellations: If a Client cancels within the Performer's free cancellation window, a full refund of the deposit is issued. Cancellations outside the free window may be subject to a fee as defined by the Performer's cancellation policy.
- Performer Cancellations: If a Performer cancels an accepted booking, the Client receives a full refund of the deposit.
- Refund Processing: Refunds are processed through Stripe and may take 5–10 business days to appear on the Client's statement.
- Disputes: If a dispute arises that cannot be resolved between the parties, either party may contact us at support@book-a-band.com for assistance. We will review disputes in good faith but are not obligated to mediate or resolve them.
10. Reviews
Clients may leave reviews for Performers after a completed booking. Reviews must reflect genuine experiences and must not contain false statements, personal attacks, or inappropriate content. We reserve the right to remove reviews that violate these guidelines.
11. Messaging & Communication
Book A Band provides in-app messaging between Clients and Performers. Messages are stored to facilitate booking communication. You agree not to use messaging to share spam, unsolicited advertisements, or harmful content. We may filter messages to protect users from sharing personal contact information prematurely.
12. Referral Program
Book A Band may offer a referral program allowing users to invite others to the platform. Referral rewards, if any, are issued at our sole discretion. We reserve the right to modify or discontinue the referral program at any time. Abuse of the referral system (including self-referrals or fraudulent sign-ups) may result in forfeiture of rewards and account termination.
13. Prohibited Conduct
You agree not to:
- Use Book A Band for any unlawful purpose
- Post false, misleading, or fraudulent information
- Harass, threaten, or abuse other users
- Attempt to circumvent the payment system or avoid platform fees
- Upload malicious software, viruses, or spam
- Scrape, crawl, or collect data from the platform without authorization
- Impersonate another person or entity
- Interfere with the operation or security of the platform
14. Intellectual Property
You retain ownership of all content you upload to Book A Band (including photos, videos, audio, and text). By uploading content, you grant Book A Band a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content solely for the purpose of operating and promoting the platform. This license ends when you delete your content or your account.
The Book A Band name, logo, and app design are the intellectual property of Book A Band. You may not use our branding without prior written permission.
15. Push Notifications
With your permission, we send push notifications for booking updates, new messages, event reminders, and other service-related alerts. You can manage your notification preferences in the app's settings or through your device settings at any time.
16. Third-Party Services
Book A Band integrates with third-party services including Stripe (payments), Clerk (authentication), and PostHog (analytics). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party providers.
17. Disclaimer of Warranties
Book A Band is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that:
- The platform will be available at all times or free of errors
- Performers will fulfill their booking obligations
- The quality of any Performer's services will meet your expectations
- Any content posted by users is accurate or reliable
18. Limitation of Liability
To the maximum extent permitted by law, Book A Band and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from:
- Your use of or inability to use the platform
- Any disputes between Clients and Performers
- Unauthorized access to your account
- Any conduct or content of any third party on the platform
Our total liability for any claims arising under these Terms shall not exceed the amount you paid to Book A Band in platform fees during the twelve (12) months preceding the claim.
19. Indemnification
You agree to indemnify and hold harmless Book A Band, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising out of your use of the platform, your violation of these Terms, or your violation of any rights of a third party.
20. Termination
You may delete your account at any time from the Profile settings. We may suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms, is harmful to other users, or is otherwise objectionable. Upon termination, your right to use the platform ceases immediately. Sections that by their nature should survive termination (including intellectual property, limitation of liability, indemnification, and dispute resolution) will remain in effect.
21. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached within 30 days, either party may pursue binding arbitration in accordance with the rules of the American Arbitration Association. You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.
22. Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices, features, or applicable laws. We will notify users of material changes through the app or via email. Your continued use of Book A Band after any changes constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the platform and delete your account.
23. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
24. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Book A Band regarding your use of the platform and supersede any prior agreements.
